In 2026, off plan became the main point of interest for Marbella’s premium market. Searches for «new projects Costa del Sol» increased by 150% over the past year. There are several reasons.

Demand for a move-in ready product

A modern buyer does not want to buy an old villa and go through 18 months of renovation. Off plan makes it possible to get a ready property of the latest generation, with a guarantee that it meets modern standards, without intermediaries.

Golden Visa cancellation and its consequences

In April 2025, the Spanish government cancelled the Golden Visa program tied to purchasing real estate from €500,000. This paradoxically boosted the off plan segment: buyers now come not for residency, but for product quality, rental yield, and long-term capital protection. What is included in the off plan purchase price

The price in the brochure is not the final figure. The real budget includes several mandatory components.

Property price

The base price under the contract with the developer. Often it is fixed at the time of booking and is not recalculated if market prices rise.

IVA tax 10%

Unlike resale real estate (where ITP 7% is paid in Andalusia), new builds are subject to 10% VAT. For an apartment priced at €700,000, this is €70,000.

AJD tax

Actos Jurídicos Documentados, 1.2% in Andalusia. For €700,000, this is about €8,400.

Legal expenses

Independent lawyer: 1 to 1.5% of the property price. For €700,000, this is €7,000 to €10,500.

Notary and registration

About 0.5 to 1% of the price. For €700,000, this is €3,500 to €7,000.

Total budget

For apartments €700,000: actual expenses about €790,000 to €795,000 (an additional €85,000 to €95,000 over the brochure price).

For a villa €3,000,000: actual expenses about €3,360,000 to €3,400,000.

Payment structure

A standard schedule for off plan projects in Andalusia.

Booking: 10% of the price when signing the contract at the reservation stage (usually 1 to 3 months before construction starts).

During construction: 30%, split into 3 to 4 payments by construction stages (foundation, walls, roof, finishing).

At handover: the remaining 60% when receiving the keys and signing the final deed at the notary’s office.

Bank guarantees

Critically important. Under Spanish law (Ley 57/68 and subsequent regulations), all buyer advance payments must be protected by a bank guarantee or an escrow account. This means that if the developer does not complete the project, the bank returns all funds paid by the buyer.

Without a bank guarantee, any advance payments are a risk. Do not sign a contract without confirmation that such a guarantee exists.

What to look at when buying off plan

A few practical recommendations.

Developer reputation. Study previously completed projects, reviews from earlier buyers, and whether there are legal disputes. Sierra Blanca Estates, DarGlobal, BRIGHT, and Insignia are companies with a proven track record.

Exact handover dates. Ask the developer for a realistic date, not a marketing one. Delays of 3 to 6 months are normal; delays of 12+ months are a serious risk.

Penalty clauses in the contract. The contract should include penalties for the developer for late handover. Standard terms: a refund of part of the price or a penalty of 5% for each 6 months of delay.

Finishing quality. Clarify what exactly is included in the base finishing: kitchen, bathrooms, floors. Often high-quality finishing costs an additional €100,000 to €300,000 on top.

Changes to the project. In most off plan projects, customization is possible (choosing materials, and the layout of some walls). This should be fixed in the contract at an early stage.

Independent lawyer. Never work with a lawyer recommended by the developer. Only an independent lawyer specializing in off plan purchases in Spain.

Financing. Many developers offer linked bank products with favorable mortgage terms for their projects. Compare them with offers from other banks.
